1. Introduction

These Terms of Use (“Terms”) govern the access to and use of the websites turistickeatrakcie.sk, slovakiasights.com, and related mobile applications (collectively the “Platform” or the “Service”).

2. Access to the Platform

May browse general information about attractions and destinations (location, GPS coordinates, address, contact details, opening hours, difficulty level, estimated visiting time, photos, videos, facilities, nearby points of interest, and similar).

Registered users

Registration is optional and may be completed via e-mail or Google Single Sign-On (SSO). Registered users gain access to extended features, such as creating trips, marking attractions as visited, submitting reviews and ratings, suggesting corrections or new attractions, uploading photos and videos, and using filters and other tools.

Account security

Registered users are responsible for maintaining the security of their accounts and login credentials. In case of unauthorized access or misuse, the user must immediately notify the Service Provider.

3. User Obligations

Users agree to provide accurate and up-to-date information during registration, refrain from posting false, misleading, inappropriate, or unlawful content, respect the rights of third parties (including intellectual property rights, personality rights, and privacy), use the Platform solely for personal, non-commercial purposes, avoid any activity that may compromise the security, functionality, or reputation of the Platform.

4. Content and Liability

The User may publish or upload content, in particular photos, videos, texts, ratings, comments or other materials (hereinafter referred to as the “User Content”) via the Platform.

The User declares and guarantees that he is the author of the User Content or has all necessary rights, consents and authorizations to publish and grant a license under these Terms and Conditions, and that by publishing the content he does not violate the rights of third parties, in particular copyrights, rights to protection of personality or the right to protection of privacy. By uploading or publishing the User Content, the User grants the Platform Service Provider an irrevocable, non-exclusive, royalty-free, worldwide, perpetual, transferable and sublicensable license to use, modify, reproduce, distribute, publicly display, archive and make available the User Content he has added to the Platform.

This license includes in particular the right to:

  • use, publish, reproduce, store and archive User Content,
  • edit, modify, shorten or otherwise process the Content,
  • create derivative works or compiled works,
  • distribute or make available the Content to the public via websites, mobile applications, social networks or other media,
  • publicly display or perform the Content,
  • use the Content for marketing, promotional or presentation purposes of the Platform.

The Service provider is entitled to appropriately edit the User Content, in particular:

  • crop photos, change their size or quality, add watermarks, filters or graphics,
  • edit video recordings, including cutting them, combining them with other videos, adding subtitles, music or graphics,

The Service provider is also entitled to combine User Content with other content or databases of the Platform and use it as part of multimedia presentations, compiled works or other projects of the Platform. The User agrees that the User Content may also be used for marketing and promotional purposes of the Platform, including its publication on social networks, in advertising materials or in other presentation outputs of the Platform.

The User bears full responsibility for the content that he publishes or uploads to the Platform. The Service Provider is not liable for User Content published by users. The Service Provider is entitled to remove or edit User Content if it is contrary to legal regulations, these Terms or good morals. By publishing the content, the User confirms that he has the consent of the persons captured in the photographs or videos to publish their likeness, if such consent is required by law.

The User also agrees that the content may be used as part of databases, compiled works, multimedia presentations or other projects of the Platform.

Reporting a violation of rights

If you believe that content published on the platform infringes your copyright or other intellectual property rights, you may contact the platform Service Provider and request that such content be reviewed and, if necessary, removed.

The notification should include in particular:

  • identification of the content that you claim infringes your rights (for example, a link to a specific page),
  • a description of the rights that are allegedly infringed,
  • information to verify your authority to exercise those rights,
  • your contact details (e.g., name and email address),
  • a statement that the information provided is accurate and that you are authorized to act on behalf of the rights holder.

Upon receipt of a notification of potential infringement, the platform Service Provider may:

  • review the notification,
  • temporarily restrict access to the content in question,
  • remove the content from the platform,
  • contact the user who posted the content.

The Service Provider reserves the right to remove content or restrict access to it without prior notice if there is a reasonable suspicion that the content violates legal regulations or the rights of third parties. The Service Provider is not responsible for the content published by users of the platform and acts solely as an information society service provider that provides a technical space for users to publish content.

If a user repeatedly posts content that infringes copyright or other rights of third parties, the Service Provider reserves the right to:

  • restrict or terminate his user account,
  • block access to the platform,
  • take other measures in accordance with legal regulations.

5. Prohibited Activities

Users shall not post unlawful, offensive, discriminatory, violent, pornographic, or misleading Content, impersonate another person or entity, collect personal data of other users without their consent, use the Platform for commercial purposes without the Service Provider’s prior written consent, circumvent technical security measures or interfere with the operation of the Platform.

6. Intellectual Property

All rights to the Platform, including design, databases, software, trademarks, and logos, belong to the Service Provider or its partners. Any unauthorized use is prohibited.

User Content

Users remain solely responsible for Content they submit. A license is granted to the Service Provider under Article 4(1).

7. Limitation of Liability

The Platform is provided “as is” and the Service Provider makes no warranties regarding the accuracy, availability, or suitability of the Platform, the content of the platform or any part of Platform. The Service Provider shall not be liable for direct or indirect damages, lost profits, loss of data, or other harm arising from the use or inability to use the Platform. Users access and use the Platform at their own risk.

8. Changes and Termination

The Service Provider may amend or supplement these Terms at any time. Users will be informed of material changes in an appropriate manner. Continued use of the Platform constitutes acceptance of the updated Terms. The Service Provider may restrict, suspend, or terminate a user’s access if they violate these Terms or applicable laws.

9. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Slovak Republic and applicable European Union law. Disputes shall be resolved before the competent courts of the Slovak Republic, unless mandatory provisions of EU law provide otherwise. 10. Final Provisions

If any provision of these Terms is deemed invalid, the remaining provisions shall remain fully effective. These Terms constitute the entire agreement between the Service Provider and the User regarding the use of the Platform. The Service Provider reserves all rights not expressly granted to the user.
